PACL Pearls group of company receives strong support from its investors and agents

PACL recives many support and Goodwill from investor and pacl agents:
Amidst all the troubles brewing up against PACL, the company is slowly, but gradually, finding light at the end of the tunnel. In spite of directives from SEBI and CBI, the investors of the company are standing by it. They believe that a company that has tried to maintain standard levels of transparency and goodwill, and has stayed genuine in its business dealings, is unfortunately trapped in a legal confusion.

Soon, the company is expected to be back on its feet. One of the investors said, "It's really perplexing, there must be some sort of a legal confusion. In my personal experience, PACL has been a good company. I have received my payments on time and not for once there was any feeling that I was being smartly duped. The management has even offered me the chance to come and crosscheck the company's financial sheets, and also any question that may have been bothering the sensitive investors".

Another one pointed out: "I hope PACL is given more time to make the payments. I have been associated with this company for many years and have complete faith in their working. Whatever SEBI is accusing them of must be some mix-up. The profits I earned through my investment here have been of great help to me. They helped me come out of a financial crisis. Just 90 days are too little."

A lady investor, who had flown to Delhi to clear her doubts, said: "If they get an extension, I am sure the investors would also get more interest on the invested amount. There are around five crore investors with PACL, according to my knowledge. An extended time limit is a must if the agencies want to safeguard the interest of the investors. If there is a possibility of investors receiving large profits, SEBI shouldn't have a problem."

The public sentiment appears to be with PACL. Whether the law feels the same way, only time will tell.

PACL to move Tribunal against Sebi order

So Sory for this updates old news on 23 august 2014 and now we show status of pacl sebi details in our next post.

New Delhi :-
Facing a Sebi order with charges of running an illicit money pooling scheme worth about Rs 50,000 crore, PACL Ltd today said it will approach the Securities Appellate Tribunal against the directive of the capital markets regulator.
“Sebi has unfortunately failed to recognize the submissions of the company that it can’t be treated like a CIS. The company would now appeal this order before the Securities Appellate Tribunal,” PACL said in a statement after the Sebi order.
“PACL limited, in its submission to the Sebi bench had submitted that it is not running a CIS.
“Further, the company has sufficient asset holdings vis-a-vis the money raised for its real estate business,” the company said.
PACL further said it “would also like to remind its customers that it has always kept their interest paramount and would continue to do so”.
“We assure our customers that their investments are safe & their interests would not be jeopardized,” the company added.
Sebi in its order earlier this evening asked PACL and its promoters and directors to refund investors’ money within 3 months and immediately stop raising money from all their collective investment schemes, after finding them guilty of raising close to Rs 50,000 crore through unauthorised CIS activities. Original post from other website this is only for information pacl blog.

PACL Promises to Earn Huge Profits for its Investors if Given Time

Business Wire India :
PACL is the real estate company having the largest land bank in India. It has over 52 successful projects to its credit in areas like Delhi, Noida, Mumbai, Mohali, Zirakpur, Vadodara, Pune, Bhathinda, Ludhiana, Banur and many such areas. But confusion has linked it with a ‘Collective Investment scheme’. So under this, PACL has been asked by SEBI to return Rs 49000 crore to the investors in a very small time frame of 3 month. But this is not fair for the company as well as the investors. Instead of directly affecting PACL’s business and asking it to return the money in such a small time, SEBI should give the company some more time.
This is because if given time, PACL can garner huge amount of revenue from its ongoing and planned projects. This simply means that with more revenues, the investors would get more interest on their investments. It’s a win-win situation for everyone.  There is possibly no reason that is sufficient enough to condemn a company if it wants to make more money for the investors. In the times where customers are heavily duped, PACL is trying to earn its investors more reward. Such work ethic is seldom seen.
“The math is simple. If a land sells for amount ‘x’, then the same land, if constructed with a well built structure, would sell for amount ‘10x’. So if given time, PACL can clear all their liabilities and earn their investors multi fold profit. In fact, according to the Land pooling policy in Delhi, If PACL constructs 60% of its 552 acre land, and sells it at the lowest price, this would alone make more than Rs 40,000 crore. So just in two years time, revenue from Delhi alone is sufficient for clearing all our liabilities. What we simply need is time. We are no criminals. We are not duping our investors at all. SEBI hasn’t given us any time.”, said , Official spokesperson for PACL.

SAT upholds SEBI order against PACL in $9.5B investment scheme case

SEBI, in August last year, ordered PACL to wind up its investment scheme and refund the money collected from investors within three months.
Securities Appellate Tribunal has upheld markets regulator Sebi's order against PACL Ltd, which was found to have garnered Rs 49,100 crore from public in the country's biggest ever 'sham collective investment scheme'.
Sebi, in August last year, ordered PACL to wind up its unauthorised collective investment scheme (CIS) and refund the money collected from investors within three months.
The company was running a land purchase scheme, where it was raising money from public to buy land. It was running a CIS without securing regulatory approval.
In the guise of selling agricultural land, PACL has collected Rs 49,100 crore from 5.85 crore customers over a period of 15 years by promising them that the investments in the schemes of the company are highly profitable, SAT order said.
However, PACL has so far issued sale deeds in respect of 19,284 investors. Further, the value of the total lands held by PACL in the form of stock in trade was Rs 11,707 crore.
Since the lands held by PACL are wholly disproportionate to the amounts collected from the customers and there is nothing on record to suggest that the company has any other assets, SAT noted.
This is the biggest-ever amount, as also the largest number of investors, so far involved in a case found to be running illegal money pooling scheme.
In a 92-page order, SAT said," Decision of Sebi that in the guise of running real estate business, PACL is running sham CIS which are detrimental to the interest of investors and consequently directing PACL to wind up the existing CIS and refund the money collected from the investors with promised return cannot be faulted."
Further, PACL has been directed to comply "with directions contained in the impugned order of Sebi dated August 22, 2014 within a period of three months from today."
Sebi first issued a notice in November 1999 to PACL, alleging that it "was operating CIS, wherein the funds of the investors were pooled and utilised towards the cost of land, registration expenses, developmental charges and other incidental expenses."
The case later went to courts, while the Supreme Court passed an order in February 2013 directing Sebi to determine whether the business of PACL fell within the purview of CIS or not, and accordingly take further action in accordance with the law.
Promoters and directors of PACL Ltd have been involved with Pearls Group and PGF Group, among others.

Securities Appellate Tribunal upholds $7.5 billion refund order against PACL

PACL INDIA LTD :
its order, SEBI said PACL was selling fixed-return investment products disguised as land-for-fund schemes.
PACL had appealed an order from the Securities and Exchange Board of India (SEBI) last year that deemed the company's investment products illegal for not complying with rules on so-called collective investment schemes.
The Securities Appellate Tribunal (SAT) has upheld a decision by the market regulator ordering property developer PACL to return $7.5 billion to investors, in a case seen as a test of the watchdog’s ability to clamp down on unregulated investment products.
PACL had appealed an order from the Securities and Exchange Board of India (SEBI) last year that deemed the company’s investment products illegal for not complying with rules on so-called collective investment schemes.
In its order, SEBI said PACL was selling fixed-return investment products disguised as land-for-fund schemes. It told the firm to return 491 billion rupees ($7.52 billion) it raised from 58.5 million customers.
PACL argued it sold land to customers and not investment products.
But the SAT, in an order published on Tuesday, backed the regulator.
SEBI has stepped up its scrutiny of unregistered investment products over the past two years, plugging regulatory loopholes that had long allowed unregulated entities to raise billions of dollars from small investors. Many ended up losing their life savings in pyramid schemes.
In 2015 alone, SEBI has passed 91 new orders closing down unregulated funds and demanding refunds for investors.
However, critics still question the regulator’s ability to enforce its directives, citing the example of Indian conglomerate Sahara, which has yet to pay back $5.7 billion to investors despite the Supreme Court upholding SEBI’s case two years ago. Sahara, whose founder is in jail, says it has reimbursed investors.
