पुलिस महानिरीक्षक करनाल मंडल हनीफ कुरेशी ने कहा कि देशभर में अलग-अलग नामों से कुछ ऐसी कंपनियां पंजीकृत हैं जो लोगों को विभिन्न तरह के आर्थिक प्रलोभन देकर उनकी मेहनत की कमाई हड़प कर रही हैं।
इस तरह की कंपनियों के खिलाफ पुलिस के अलावा अन्य जिम्मेदार संस्थाएं तत्परता से कार्रवाई कर रही हैं। इसी कड़ी में भारतीय प्रतिभूति और विनियम बोर्ड ने ऐसी 63 कंपनियों को ब्लैक लिस्ट किया है।
आम जनता का भी इस तरह की कंपनियों के प्रति जागरूक रहना जरूरी है। पुलिस महानिरीक्षक ने बताया

पुलिस महानिरीक्षक ने कहा कि कि आम आदमी किसी भी कंपनी में पैसों का निवेश करने से पूर्व उस कंपनी के बारे में अच्छी तरह से जानकारी एकत्रित कर लें। उसके पश्चात ही पैसों का निवेश करे। उन्होंने कहा हालाकि पुलिस विभाग इस तरह के ठगों के खिलाफ निरंतर कार्रवाई करता है परंतु यदि आम आदमी पहले ही जागरूकता पूर्वक पैसों का निवेश करे तो ऐसी हेराफेरी से बचा जा सकता है। पुलिस अधीक्षक अरूण सिंह ने कहा कि उक्त कंपनियों के झांसे में न आए और किसी भी कम्पनी में पैसा निवेश करने से पहले कम्पनी के बारे अच्छी तरह से जानकारी प्राप्त कर लें तभी अपना पैसा निवेश करे।

Securities Appellate Tribunal upholds $7.5 billion refund order against PACL

PACL had appealed an order from the Securities and Exchange Board of India (SEBI) last year that deemed the company's investment products illegal for not complying with rules on so-called collective investment schemes.
The Securities Appellate Tribunal (SAT) has upheld a decision by the market regulator ordering property developer PACL to return $7.5 billion to investors, in a case seen as a test of the watchdog’s ability to clamp down on unregulated investment products.
PACL had appealed an order from the Securities and Exchange Board of India (SEBI) last year that deemed the company’s investment products illegal for not complying with rules on so-called collective investment schemes.
In its order, SEBI said PACL was selling fixed-return investment products disguised as land-for-fund schemes. It told the firm to return 491 billion rupees ($7.52 billion) it raised from 58.5 million customers.
PACL argued it sold land to customers and not investment products.
But the SAT, in an order published on Tuesday, backed the regulator.
SEBI has stepped up its scrutiny of unregistered investment products over the past two years, plugging regulatory loopholes that had long allowed unregulated entities to raise billions of dollars from small investors. Many ended up losing their life savings in pyramid schemes.
In 2015 alone, SEBI has passed 91 new orders closing down unregulated funds and demanding refunds for investors.
However, critics still question the regulator’s ability to enforce its directives, citing the example of Indian conglomerate Sahara, which has yet to pay back $5.7 billion to investors despite the Supreme Court upholding SEBI’s case two years ago. Sahara, whose founder is in jail, says it has reimbursed investors.

नई दिल्ली। नए अधिकारों से लैस पूंजी बाजार नियामक सेबी ने सबसे बड़ी कार्रवाई करते हुए पीएसीएल लिमिटेड (प‌र्ल्स ग्रुप) को अवैध निवेश स्कीम बंद करने का आदेश दिया है। नियामक ने 92 पन्नों के आदेश में कहा है कि कंपनी निवेशकों से वसूली 50,000 करोड़ रुपये की रकम तीन महीने के भीतर लौटाए। कंपनी को 15 दिनों के भीतर स्कीम को बंद करने व रकम वापसी की रिपोर्ट सेबी के पास जमा करानी होगी। इसमें बताना हो

गा कि पैसों की वापसी के लिए धन की व्यवस्था कहां से की जाएगी। पीएसीएल ने कहा है कि वह सेबी के आदेश के खिलाफ प्रतिभूति अपीलीय ट्रिब्यूनल में जाएगी।
सेबी कंपनी, इसके नौ प्रमोटरों व निदेशकों के खिलाफ धोखाधड़ी और अनुचित कारोबारी गतिविधियों के लिए कानूनी कार्यवाही भी शुरू करेगा। सुप्रीम कोर्ट के निर्देश पर सेबी के सामूहिक निवेश स्कीम (सीआइएस) नियमों के उल्लंघन को लेकर भी इन पर कार्रवाई होगी। इनमें तरलोचन सिंह, सुखदेव सिंह, गुरमीत सिंह, सुब्रत भंट्टाचार्य, निर्मल सिंह भंगू, टाइगर जोगिंदर, गुरनाम सिंह, आनंद गुरवंत सिंह व उप्पल देविंदर कुमार के नाम शामिल हैं। पीएसीएल व निर्मल सिंह भंगू समेत इसके शीर्ष अफसरों के खिलाफ सीबीआइ जांच भी चल रही है। कंपनी के प्रमोटर व डायरेक्टर प‌र्ल्स ग्रुप और पीजीएफ ग्रुप में भी शामिल हैं।
पीएसीएल ने खुद स्वीकार किया है कि उसने 49,100 करोड़ की भारी-भरकम रकम निवेशकों से जुटाई है। आदेश में कहा गया है कि यह राशि और भी बड़ी होती अगर कंपनी ने एक अप्रैल, 2012 से 25 फरवरी, 2013 के बीच जुटाई गई रकम की भी जानकारी दी होती। निवेशकों का आंकड़ा भी कोई छोटा-मोटा नहीं है। कंपनी ने यह रकम करीब 5.85 करोड़ निवेशकों से जमा कराई है। कई निवेशकों से जमीन देने के नाम पर रकम वसूली गई है।
यह किसी अवैध सीआइएस के तहत देश में निवेशकों से जमा कराई गई सबसे बड़ी राशि है। इसके निवेशकों की संख्या भी अब तक का सबसे बड़ा ग्राहक आंकड़ा है। यह सहारा समूह से भी बड़ा मामला है। सेबी की पहल पर सुप्रीम कोर्ट ने सहारा को निवेशकों के 24,000 करोड़ रुपये लौटाने का आदेश दे रखा है।
प‌र्ल्स की यह स्कीम सेबी की निगरानी के अंतर्गत चल रहे सबसे लंबे समय से चल रहे मामलों में से एक है। बाजार नियामक से पीएसीएल को 16 साल पहले फरवरी, 1998 में ही आदेश दिया था कि वह न तो कोई नई योजना शुरू कर सकती है, और न ही मौजूदा स्कीमों के तहत पैसे जमा कराना जारी रख सकती है।
इस बीच, कंपनी कहती रही है कि वह कोई भी गैरकानूनी स्कीम नहीं चला रही है और असल में जमीन की बिक्री व खरीद का कारोबार कर रही है। सेबी ने 1999 में नोटिस जारी कर कंपनी पर सामूहिक स्कीम चलाने का आरोप लगाया था। इसमें कहा गया था कि कंपनी निवेशकों से जमा पैसों का जमीन खरीदने, रजिस्ट्री कराने, विकास शुल्क व अन्य खर्चो के लिए इस्तेमाल कर रही है।

पर्ल्स ग्रुप को 49,100 करोड़ रुपये निवेशकों के लौटाने पर अदालत ने लगाई रोक

मुंबई। भारतीय प्रतिभूति अपीलीय ट्राइब्यूनल (सैट) ने बाजार नियामक सेबी के उस आदेश पर रोक लगा दी है जिसमें प्रॉपर्टी डेवलपर पीएसीएल को निवेशकों का 49,100 करोड़ रुपया लौटाने का आदेश जारी किया था। सेबी ने अवैध सामूहिक निवेश योजना को लेकर पीएसीएल के खिलाफ कार्रवाई की थी। इसके बाद पिछले साल सेबी के आदेश के खिलाफ पीएसीएल ने ट्रिब्यूनल में अपील किया था।
सेबी ने अवैध योजनाओं के जरिये निवेशकों से धन जमा करने के खिलाफ कड़ी कार्रवाई करते हुए पीएसीएल लिमिटेड (पहले पर्ल्स एग्रोटेक कॉर्पोरेशन) को तीन महीने के भीतर 49 हजार 100 करोड़ रुपये निवेशकों को लौटाने का आदेश दिया था। सेबी ने कंपनी से अवैध सामूहिक निवेश योजना (सीआईएस) को बंद करने को भी कहा है।

सेबी के आदेश के बाद पीएसीएल ने इसे प्रतिभूति अपीलीय ट्राइब्यूनल (सैट) में चुनौती दी। वहीं, पीएसीएल के बयान में कहा गया कि दुर्भाग्य से सेबी इस बात पर ध्यान नहीं दे सका कि कंपनी ने कहा था कि उसे सीआईएस नहीं माना जाए। कंपनी ने कहा है, 'पीएसीएल ने सेबी की बेंच के सामने कहा था कि वह सीआईएस नहीं चला रही है। कंपनी ने अपने रीयल एस्टेट कारोबार के लिए जो धन जुटाया है, उसके पास उचित मात्रा में परिसंपत्तियां हैं।'
सेबी ने कहा है कि वह उच्चतम न्यायालय के एक दिशानिर्देश के अनुसार कंपनी तथा निदेशकों के खिलाफ धोखाधड़ी तथा व्यापार में अनुचित व्यवहार करने वह सामूहिक निवेश योजनाओं (सीआइएस) के बारे में सेबी के नियमों के उल्लंघन के आरोप में पीएसीएल के खिलाफ कार्रवाई की है।
भारतीय प्रतिभूति एवं विनिमय बोर्ड (सेबी) ने इस संबंध में 92 पृष्ठ का आदेश जारी किया था। इसके अनुसार कंपनी ने खुद स्वीकार किया है कि उसने 49,100 करोड़ रुपये जुटाये है और अगर पीएसीएल एक अप्रैल 2012 से 25 फरवरी 2013 के बीच जुटाये गये कोष का पूरा ब्योरा दे तो यह राशि और भी अधिक हो सकती है।
जिन निवेशकों से यह राशि जुटायी गयी, उनकी संख्या करीब 5.85 करोड़ है। इनमें वे ग्राहक भी शामिल है। जिन्हें जमीन आवंटित करने की बात कही गयी थी और उन्हें अभी तक जमीन नहीं दी गयी। अवैध तरीके से धन जुटाने के मामलों में यह न केवल राशि के लिहाज से बल्कि निवेशकों की संख्या को लेकर भी सबसे बड़ा मामला है।
वही, पीएसीएल तथा निर्मल सिंह भांगू समेत उसके शीर्ष कार्यकारियों के खिलाफ सीबीआई भी जांच कर रही है। साथ ही यह सेबी की जांच के घेरे में पुराने मामलों में से एक है। नियामक ने 16 साल पहले फरवरी 1998 में पीएसीएल को कहा था कि वह न तो कोई योजना शुरू कर सकती है और न ही अपनी मौजूदा योजनाओं के तहत कोष जुटा सकती है।
कंपनी ने अपनी दलील में कहा कि वह कोई अवैध योजना नहीं चला रही है और जमीन की खरीद-बिक्री में शामिल है। सेबी ने अवैध तरीके से धन जुटाने की योजना चलाने को लेकर 1999 में पीएसीएल को नोटिस जारी किया था। बाद में मामला अदालतों में गया। उच्चतम न्यायालय ने पिछले साल फरवरी में आदेश जारी कर सेबी को यह पता लगाने को कहा कि क्या पीएसीएल का कारोबार सामूहिक निवेश योजना के दायरे में आता है या नहीं और कानून के मुताबिक कार्रवाई करने को कहा।

Pacl Top News Updates Pearls group of company customer fund safe or CBI News

The Securities and Exchange Board of India has ordered PACL, formerly called Pearl Agrotech Corporation, and its promoters to refund over Rs 44,376 crore that it collected until March 2012 through collective investment schemes (CIS).

This is the biggest crackdown by Sebi on an entity in monetary terms. PACL has three months to comply with the order. The regulator has said that it would take steps to register a civil/criminal case in case of non-compliance.

“PACL Limited, its promoters and directors, shall wind up all the existing Collective Investment Schemes of PACL Limited and refund the monies collected by the said company under its schemes with returns which are due to its investors… within a period of three months,” said the Sebi order passed by its whole-time member Prashant Saran.

Armed with the new powers conferred upon it under the new Sebi Bill, the order further said, “Sebi shall also initiate attachment and recovery proceedings under the Sebi Act.”

In a statement on Friday, PACL said that it will approach the Securities Appellate Tribunal against the directive of the capital markets regulator. “Sebi has unfortunately failed to recognise the submissions of the company that it can’t be treated like a CIS. The company would now appeal this order before the Securities Appellate Tribunal,” PACL said.

“PACL limited, in its submission to the Sebi bench had submitted that it is not running a CIS,” the statement added.

Sebi has been pursuing the case for almost 17 years and its probe spanned various locations including Delhi, Mumbai and Rajasthan.

The case against PACL and its promoters and directors including Tarlochan Singh, Sukhdev Singh, Gurmeet Singh and Subrata Bhattacharya, dates back to 1997, when Sebi first alleged that the company was running a CIS without its permission.

It found that the company was running a land purchase scheme where it was collecting money from investors to buy land. PACL moved the Rajasthan High Court, which in an order on November 28, 2003, held that the schemes of were not CIS and quashed two letters Sebi sent in 1999.

Sebi appealed to the Supreme Court against the order. The apex court on February 26, 2013, set aside the high court order, paving the way for Sebi to pursue the case, which has resulted in Friday’s order.

PACL had claimed to Sebi that it got its revenue from the sale of land, flats, commercial space etc and had other business activities such as sale of farm produce.

The Sebi probe, however, established that until March 2012, the company had received a total customer advance of Rs 44,736 crore under two land-linked plans and had also paid commissions of Rs 7,893 crore to its agents.

Sebi also found out that while PACL had 4.63 crore customers until March 2014 and the amount outstanding against them stood at Rs 29,420 crore, the value of total lands with the company at that point was only Rs 11,707 crore.
